1. Parties to This Agreement
1.1 These Terms are a binding legal agreement between you (“User”) and LumiVras Inc. (“Company,” “we,” “our,” or “us”).
1.2 We grant you a limited, non-transferable, revocable right to access and use our Services.
1.3 You may not alter or bypass these Terms. Any attempt to do so will be null and void.
1.4 By accessing the Services, you confirm that you are at least 18 years old (or the legal age of majority in your jurisdiction).

3. LumiVras Services
3.1 Posting Items
Users may post products (including bicycles and related items) for sale by uploading accurate images and descriptions.
3.2 Buying & Selling
LumiVras facilitates secure transactions through its integrated Payment Solution. All transactions are strictly between buyers and sellers. LumiVras is not a direct party to the transaction except as outlined in our Buyer Protection Policy.
3.3 Payment Accounts
Payments are processed through third-party providers. By using LumiVras’ payment services, you agree to the provider’s separate terms and conditions.
3.4 Taxes
You are responsible for complying with applicable tax laws. LumiVras may collect and remit sales tax where required by law.
3.5 Shipping
Sellers are responsible for compliance with our Shipping Policies. Restricted or hazardous items (e.g., lithium batteries) must be shipped according to federal and state regulations. LumiVras is not liable for shipping delays, damages, or losses.
4. User Code of Conduct
You must not:

Harass, abuse, or harm other users.

Circumvent LumiVras to transact offline or outside the platform.

Sell restricted, counterfeit, or illegal goods.

Misrepresent your identity or impersonate others.

Use cryptocurrency, unauthorized gift cards, or non-approved payment methods.
5. Information We Collect
We may collect both Personal Information (name, address, contact, payment details) and Anonymous Information (browser type, device, IP address, usage patterns).

6. Data Usage & Security

You are responsible for maintaining confidentiality of your account credentials. LumiVras is not liable for unauthorized access resulting from your failure to secure your login details.
8. Content Rights
Users retain ownership of their content but grant LumiVras a non-exclusive, royalty-free license to use, distribute, and display content as needed to operate the Services.
9. Intellectual Property
All trademarks, logos, and proprietary materials are owned by LumiVras Inc. or licensed to us. Unauthorized use is strictly prohibited.
10. Buyer Protection
Our Buyer Protection Program ensures claims are handled fairly when:

A product arrives damaged or defective.

Fraudulent or counterfeit goods are sold.
⚠️ Claims must be submitted within 48 hours of delivery. A bicycle not fitting in size is not a valid reason for return.
11. Limitation of Liability
To the fullest extent permitted by law, LumiVras and its affiliates shall not be liable for indirect, incidental, or consequential damages. Our maximum liability will not exceed the greater of $100 or the total fees paid to us in the 12 months preceding the claim.
12. Dispute Resolution & Arbitration

All disputes must be resolved individually. Class actions are not permitted.

Except for small claims or intellectual property matters, disputes must be resolved by binding arbitration administered by JAMS.

You may opt out by emailing support@lumivras.com within 30 days of accepting these Terms.
13. Termination
We reserve the right to suspend or terminate your account at our discretion for violation of these Terms. Attempting to access the Services after termination is prohibited.
14. General Provisions

Force Majeure: LumiVras is not responsible for service interruptions due to events beyond our control (e.g., natural disasters, strikes, government actions).

Data Transfers: Your data may be transferred as part of a corporate restructuring, merger, or sale.

Entire Agreement: These Terms, along with our Privacy Policy and other posted policies, represent the complete agreement between you and LumiVras.
